Barrett, whose death resulted from injuries received when he was struck by the truck owned by defendant Nash Finch Company, driven by the defendant Ellsworth Pallies, while decedent was attempting to push his stalled car from the highway. The case was tried before D. M. Cameron, Judge, and a jury, and a verdict of $10,000 returned for plaintiff. From an order denying their alternative motion for judgment or a new trial, defendants appealed.
